Description:

House Bill 1160 aims to revise certain provisions regarding emergency management in South Dakota. 

ACLU position: 

The ACLU of South Dakota opposes this bill. House Bill 1160, in its current form, appears to align protests with hostile military action, and disorderly conduct as reasons to declare an emergency. Peacefully protesting is guaranteed by the United States Constitution. 

Allowing an elected leader to declare a protest something that is an emergency will chill or stifle the free speech rights of every South Dakotan.
