UPDATE: The House lawmakers voted to kill House Joint Resolution 5003. 

House Joint Resolution 5003 would create a ballot measure for a South Dakota Constitutional amendment defining a human being as "an individual living member of the species of Homo sapiens, including the unborn human being during the entire embryonic and fetal ages from fertilization to full gestation."

The ACLU of South Dakota opposes because it could have wide-ranging and unforeseen consequences for the health and well-being of all people who can get pregnant. This proposed “personhood amendment” to our state constitution could give the legislature the right to classify abortions as a crime and could likely ban abortion in all cases. But House Joint Resolution 5003 could have implications beyond abortion. This proposed “personhood amendment” could not only put a person's right to an abortion in danger, but also threaten oral and emergency contraception, IUDs, in vitro fertilization clinics, stem cell research, potentially block pregnant people from life-saving medical treatment, and more.
