Background: Senate Bill 140 is an act to revise provisions related to inmate compensation.

Our Stance: The ACLU of South Dakota supports Senate Bill 140.

This legislation would require correctional facilities pay inmates at least $1.25 per hour for work performed and would require the facility to deposit 25% of all compensation earned by an inmate into a personal savings account that can only be used by the inmate once they are discharged. The interest accrued from these funds will be deposited into the crime victims' compensation fund by the correctional facility official quarterly. The ACLU supports policies that pay incarcerated workers a fair wage and allows them to save money for reentry after they are released.
