Background: House Bill 1274 would restrict the delivery of an abortion-inducing medicine, drug, or substance into this state and provide a criminal and a civil penalty therefor, and provide a civil action for the wrongful death of an unborn child.

Our Stance: The ACLU of South Dakota opposes House Bill 1274.

Mifepristone’s excellent safety record, including when prescribed through telemedicine, has been confirmed by more than a hundred peer-reviewed studies and leading medical authorities like the American Medical Association and the American College of Obstetricians and Gynecologists. Criminalizing health care providers and those seeking care is government overreach and any restrictions on medication abortion would be medically and legally unjustified.
