Background: House Bill 1275 would create requirements for age verification and parental consent for application stores and to provide a penalty therefor.

Our Stance: The ACLU of South Dakota opposes House Bill 1275.

This legislation would stifle freedom of expression online by requiring all users, including adults, to verify their ages before using existing social media accounts or opening new ones. It also would require any users who are minors to obtain explicit parental consent for social media usage. This threatens the free speech rights of all South Dakotans, forcing us to hand over our private data or lose the ability to participate in robust online conversation.
