Background: House Bill 1276 would establish policies and procedures for the use of solitary confinement in a juvenile facility.

Our Stance: The ACLU of South Dakota supports House Bill 1276.

This legislation would prohibit the use of solitary confinement on juveniles for any reason other than a temporary behavior response. Normal human contact and a range of age-appropriate services and programming are essential to a child’s development, education, and rehabilitation. Using solitary confinement as punishment can cause irreparable harm to juveniles.
